Years ago, we filed lawsuits on behalf of dozens or hundreds of our clients who alleged they were victims of timeshare fraud. Within weeks, Wyndham sued us – the attorneys for timeshare victims. Within a few more weeks, Bluegreen sued us. They are still suing us to this day using a huge law firm with several hundred attorneys. There is no telling how much money they have spent on legal fees to sue us.

To this day, despite years of litigation, they have not obtained one dime from us. They have never obtained one order from any Court in the country that tells us to stop fighting for victims of timeshare fraud. Yet they continue to try to put us out of the business of suing timeshare pushers.

If we are catching this much flak from the timeshare industry, are we over the target ? You bet we are.

One timeshare pushing company has offered to drop the lawsuit against us if we would agree (among other things) to stop suing them forever. Despite the substantial personal costs to us to defend the lawsuit, we won’t agree to stop helping our clients.

Founding Partner

Scott Montgomery

Scott Montgomery (Founding Partner) was born and raised in Missouri where he attended Kickapoo High school and the University of Missouri. He’s been a lawyer since 1994. He started his own practice on January 1, 2000. He realized the true nature of the timeshare industry a few years and has been fighting to assist victims of the timeshare pushers since then. His work has led to being sued personally by two of the largest timeshares pushing companies in the world which have spent untold amounts of money pursuing him to no avail.

Scott is one of the founders of the firm. He has four children named Luke, Walker, Tara, and Tiger who is 18 months old. He is married to his best friend, Amanda. They live with the two younger children in Springfield, Missouri, near Branson, along with the barn cat named Miley and two old horses.

Todd Newcomb

Todd Newcomb (Founding Partner) was born and raised in Missouri, growing up in the State Capitol & attending Jefferson City High School, Missouri State University & University of Missouri. He’s been a lawyer since 2000. He started his own practice July 15, 2005. He was shocked to discover the true nature of the timeshare industry several years ago and has devoted himself to fighting for victims of the industry ever since. Two of the largest resorts in the world have sued him personally and spent untold amounts of money in attempt to stop the fight. Not a chance.

Todd is one of the founders of the firm. He has one child named Duke. Todd enjoys watching comedies in his downtime such as Rick and Morty, South Park, The Office, and timeshare presentations. He lives in Springfield Missouri, near Table Rock Lake, which is where you can find him on summer weekends enjoying the Ozarks with Duke.

David Vaughn

David Vaughn (Partner) is a lifelong Missouri resident, father of three sons, and soon to be grandfather for the first time. He attended the University of Missouri-Columbia, just a short trip from the family farm he grew up on. After obtaining his undergraduate degree from Mizzou, he attended law school at the University of Missouri – Kansas City, graduating in 1990. 2020 marks his 30th year as an attorney. David‘s practice has been primarily in major civil litigation, with many successful jury trials over the last three decades. His primary area of practice now is representing clients who feel they were taken advantage of by timeshare companies. Making a difference in their lives is challenging and rewarding.

Andrea D. Cendroski

Andrea D. Cendroski, Litigation Paralegal with almost a decade of experience in the legal field, Andrea has become an integral part of this law firm. Before coming to Montgomery and Newcomb, she gained years of experience working in criminal defense and family law where she fostered lasting connections with court clerks, prosecuting attorneys, process servers and clients. Since joining Montgomery and Newcomb in October of 2019, Andrea assists all three of our attorneys with cases ranging from criminal defense, family law, civil litigation, personal injury and workman’s compensation.

Andrea received her associate degree in applied science with an emphasis on paralegal studies in 2012 and graduated Magna Cum Laude. She is also a certified notary public in Greene County.

A native to the area, Andrea enjoys spending time outdoors kayaking, fishing and spending time with her family and four dogs. She is also a member of The Fraternal Order of Eagles where she donates her spare time helping to raise money for many local charities.

Brittany Campbel

Brittany Campbel - Parlegal was raised in Iowa and moved to Springfield in 2003. She lives with her 13-year-old son and two cats. She has been a paralegal with the firm for 5 years. In her spare time, Brittany enjoys reading, writing, attending concerts, and the occasional Netflix binge.
Deed Back Specialist

Tamra Arndt

Tamra Arndt - Deed Back Specialist has been in the Customer Service industry for the last 15 years. She has always been dedicated to and enjoys helping people in any way possible. She came to Montgomery and Newcomb over a year ago and has been putting her customer service skills to work as one of our deedback specialist in the firm. She works alongside the clients and the resorts in hopes to get our client the best possible outcome in getting released from their timeshare.

When Tamra is not at M&N you will find her with her husband and their 4 children living the best life they can and making as many memories as possible. She also owns a photography business, where she captures life's little moments for others in hopes of not letting them fade away.

Office Manager

Rebecca Patterson

Rebecca Patterson, manager of the Montgomery and Newcomb Law Firm, was born and raised in the area. Rebecca has worked in customer service for over 15 years and has always taken great pride in her work. Rebecca started with Montgomery and Newcomb almost two years ago and has really helped with the growth of the firm. She is passionate about her work and enjoys helping people.

When she isn’t working she is most likely spending time with her two amazing sons, Ollie and Omni and their dogs Gertie and Twinkie. Rebecca enjoys hiking, floating, and spending time with her family.

Hunter P. DeLong

Hunter P. DeLong- Legal Assistant was born and raised in Springfield, Missouri. He attended New Covenant Academy where he was involved in Student Counsel, Debate, and Future Business Leaders of America. After graduating from New Covenant Academy, he attended Drury University where he majored in Biology and Mathematics and was involved with the Interfraternal Counsel, Kappa Alpha Order, and College Republicans.

While at Drury, he worked at Turner Reid Duncan Loomer and Patton, PC and Stange Law Firm where he received experience in Family, Personal Injury, and Corporation Defense Law.

After graduating Magna Cum Laude from Drury, he started working at Montgomery and Newcomb, LLC while he studies for the LSAT and prepares for Law School.

JT Kendall

JT- Client Intake Coordinator is a Springfield native and graduated cum laude with honors from Missouri State University with a BA in Anthropology. JT comes from a professional background in event planning & hospitality management, which means he always gives great client service as our Client Intake Coordinator. When he’s not helping out new clients at M&N, he can be found kayaking on the river, performing in community theatre, or chillaxing at home with his partner Brock and their two handsome cats, Milo & Oscar.

Holly Olsen

Holly Olsen- Client intake assistant grew up in North Pole, Alaska, during the “pipeline era”, where she attended North Pole High School. She left Alaska with her new husband as he followed his military career.

Holly graduated from Delta Career College for secretarial training. She is a “jack of all trades”, having worked retail, day care, customer service, school district, secretarial, aviation weather and even as a professional actress for a summer show. She has also pursued many hobbies; ukulele, painting, stained glass mosaics, quilting and woodworking. She even helped her parents build their house and published her own children’s’ books with her sisters.

Coming from parents with a strong work ethic, Holly has learned to work hard for her customers, with compassion and detail. She understands the struggles of her clients and the frustrations of trying to get released from a timeshare and does her best to work towards those goal’s.

She and her husband, Tom have raised three children, Travis, Sara and Emily, who have added three wonderful spouses to the family. Holly and Tom have been blessed with their first grandson recently, William.

Can I Stop Paying My

Timeshare Maintenance Fees?

Whether or not you decide to continue paying your maintenance fees is a personal financial decision. It is generally best to stay current with any maintenance fees, annual dues, and mortgage or loan payments, if possible. If you decide to stop paying your fees or loans, the resort may take the following actions against you or your estate:

 

  • Send your account to collections
  • Damage or ruin your credit
  • Foreclose on your timeshare
  • Sue you for an unpaid loan balance
  • File a claim against your estate
